These Terms of Use explain the basis on which Shop Smarty makes its website, comparison tools, content and account features available. Please read them before using the service. By continuing to use Shop Smarty, you agree to these terms. If you do not agree, you should stop using the service.

Shop Smarty helps people discover products and retailer offers. It is not the seller of the products shown on the site and does not become a party to purchases made on a retailer's website.

Shop Smarty is a company established in the United Kingdom.

In these terms, "Shop Smarty", "we", "us" and "our" refer to that operator. "You" and "your" refer to the person using the website or any related service. Questions about these terms can be sent to us via the form at the bottom of the page.

These terms apply to the Shop Smarty website, any account area, product comparison pages, editorial content, personalised modules, saved lists, favourites, wishlists, price alerts and other services that link to them. Separate terms may apply to a particular promotion or feature. Where separate terms conflict with these terms, the separate terms take priority for that promotion or feature.

You must have legal capacity to agree to these terms. Account and alert features are intended for people aged 16 years old or over. A parent or guardian should supervise any permitted use by a younger person.

We may update these terms when the service, our commercial arrangements or the law changes. The date at the top shows when this version was last revised. Material changes may also be highlighted on the site or sent to registered users where appropriate.

The revised terms apply from the date stated in the updated document. Continued use after that date means you accept the revised terms, except where the law requires another form of agreement.

Shop Smarty is a product discovery and comparison service. Features may include:

• searching or browsing products, categories, brands and sales;
• comparing offers, prices, discounts and delivery information;
• viewing product details, price history and editorial content;
• saving favourites, wishlists, lists and recently viewed products;
• creating price or availability alerts;
• receiving recommendations and promotional content; and
• following links to independent retailers.

We may add, remove, test or change features. We do not promise that every retailer, product or offer available in the market will be listed, or that the service will meet every user's needs.

Retailers shown on Shop Smarty are independent businesses. When you select an offer, you normally leave our site and complete any purchase directly with the retailer. Your contract for the product is with that retailer, not with Shop Smarty.

The retailer is responsible for its product description, stock, final price, payment process, delivery, returns, cancellation rights, customer service, guarantees and warranties. You should review the retailer's terms, privacy notice and returns information before ordering.

We do not act as an agent for you or for a retailer unless a page clearly says otherwise. We do not take payment for retailer products and cannot cancel, refund or change a retailer order. A complaint about an order or product should first be made to the retailer. Our complaint handling policyexplains what we can help with.

Product and offer information may come from retailers, affiliate networks, data providers, public web pages or our own processing. We work to keep information useful and current, but feeds can be delayed and errors can occur. A price displayed on Shop Smarty may therefore differ from the price shown by the retailer when you click through.

Before buying, check the retailer's page for the final item specification, variant, VAT treatment, delivery charge, installation charge, finance terms, stock status and total payable amount. The retailer's confirmed checkout information takes priority over information shown by us.

Price and availability alerts are a convenience, not a guarantee. An alert may be delayed, missed or sent after an offer changes. Creating an alert does not reserve a product, fix a price or create a right to purchase.

Search results and product modules may be ordered using factors such as relevance, product match, price, discount, stock signals, delivery data, retailer data quality, popularity, freshness and the way people interact with the service. Where permitted, saved activity and browsing behaviour may also be used to tailor recommendations.

Commercial relationships can influence whether an offer is available to us and can influence clearly labelled advertising or promotional placements. They do not mean that every ordinary result is a paid endorsement. We explain our approach in the advertising disclosure.

No ordering method guarantees the cheapest offer or best product for every person. You remain responsible for deciding whether an item, retailer or offer is suitable.

Shop Smarty may receive a fee when you click an outbound link, make a purchase, submit a lead or interact with sponsored content. We may also be paid for display advertising, promoted placements, email campaigns or other marketing services.

These payments support the operation of the service. Unless a retailer states otherwise, the commission we receive does not change the price you pay. Sponsored or promoted material should be identified with a label such as "Sponsored", "Advertisement", "Promoted" or "Paid partnership".

Some features require an account. You must provide accurate information, keep it reasonably up to date and protect your sign-in credentials. You are responsible for activity carried out through your account unless it results from our failure to use reasonable security.

You may be able to sign in using Google or Apple. In that case, Google and Apple's own terms and privacy arrangements also apply to your relationship with Google and Apple. You must not access another person's account or allow your account to be used unlawfully.

Tell us promptly through the form on this page if you believe an account has been compromised. We may require reasonable verification before changing account details or disclosing information.

We may send service communications needed to operate an account or feature, including security notices, password messages, alert confirmations and updates you ask us to provide. Depending on your choices and applicable law, we may also send marketing or personalised sale updates.

You can manage available preferences in your account, use an unsubscribe link where provided, change browser push permissions or contact us. A preference change may take a short time to apply. We may still send essential account or security messages after you opt out of marketing.

You may use the service for lawful, personal and non-commercial purposes.

You must not:

• break any law or infringe another person's rights;
• submit false, abusive, threatening, defamatory or harmful material;
• impersonate another person or misrepresent your connection with us;
• introduce malware or attempt unauthorised access to systems or data;
• interfere with, overload, probe or circumvent security or rate limits;
• scrape, harvest, copy or reuse substantial parts of the service by automated means without our written permission;
• reverse engineer or attempt to extract non-public source code; or
• use the service to build or enrich a competing commercial database.

Search engines may index public pages in accordance with our technical instructions. Written permission may be subject to separate conditions.

The Shop Smarty name, design, software, databases, page layouts, original text, graphics and other materials are owned by us or licensed to us and are protected by intellectual property laws. Product names, logos, images and descriptions may belong to retailers, brands or other rights holders.

We grant you a limited, revocable, non-exclusive right to access and use the service for its intended personal purpose. You may print or save a reasonable extract for private use, but you must not republish, sell, license, systematically copy or commercially exploit our material without permission from the relevant rights holder.

To report suspected infringement, contact us using the form at the bottom of the page with enough information for us to locate and assess the material.

We aim to keep the service available but do not promise uninterrupted or error-free access. Maintenance, security work, third-party failures, network issues or events outside our reasonable control may affect it.

We may restrict, suspend or close an account, alert or other feature where reasonably necessary to protect users, enforce these terms, investigate misuse, comply with law or discontinue a service. Where appropriate, we will try to give notice and a way to challenge a decision.

Links to retailers and other third parties are provided for convenience. We do not control their websites, apps, security, content or business practices. A link does not by itself mean that we approve every statement, product or service available there.

Third-party services can change or become unavailable without notice. You access them at your own discretion and subject to their terms and privacy information.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Your statutory consumer rights are not affected.

Shop Smarty is provided primarily as a free information and discovery service. Subject to the paragraph above, we are not responsible for:

• a retailer's acts, omissions, products, delivery or customer service;

• differences between our data and a retailer's live information;

• loss caused by relying on an alert as a guarantee or reservation;

• third-party websites, networks or services outside our control; or

• loss that was not reasonably foreseeable when you began using the service.

The service is supplied for domestic and private use. If you use it for business purposes, we will not be responsible for loss of profit, revenue, business, anticipated savings, opportunity, goodwill or business data, to the fullest extent permitted by law.

Our privacy policy explains how we use personal information. Our cookie policy explains cookies, local storage and similar technologies, including how to manage choices.

These terms, their subject matter and their formation are governed by the law of the United Kingdom. If you are a consumer resident in another part of the United Kingdom, you may also have mandatory rights under the law where you live.

The courts of the United Kingdom will have jurisdiction, subject to any mandatory right a consumer has to bring or defend proceedings in another UK court. Before starting formal proceedings, please contact us so that we can try to resolve the issue.

If part of these terms is found unenforceable, the remaining parts continue to apply. A delay in enforcing a right does not waive that right. No person other than you and the Shop Smarty operator has a right to enforce these terms, except where the law says otherwise.
